In the petition to terminate the contract with the City, who heads construction Villegas, in relation to the new football stadium and a series of works, the following statement:
First we recall that in August 2006 Caravaca City Council awarded the land on which is the current municipal soccer field 'he dwells, for further residential use, a Union Temporal de Empresas (UTE), consisting of Villegas, along with two other builders.
In return, the said joint venture had to do a significant volume of works in the village, and a new football stadium with a capacity of 3,000 locations, under the standards of FIFA, with all necessary services, parking and vehicular access.
With regard to works in the village, we can say that they have made almost entirely (under Gran Via, Tracks Salvador, new outdoor pool and the Park "Garcia Esteller).
Failure to complete the Interpretation Centre "Mills" and the driver education track paralyzed by the presence of archaeological remains.
For all these works, the joint venture claims nearly 10 million euros to terminate the contract, blaming the failings at City Hall.
The problem is that the main objective of the award has not been met, ie the construction of the new stadium, since everything should be completed for almost two years.
All this reflects the fact that the City Council have, in our view, such an accumulation of irregularities since the beginning of this issue, which has led to a recruitment absolutely foolhardy and unworkable and in many respects as provided unadjusted in the Public Procurement Act in force at that time.
Some of the aspects that are violated in Contract Law, is available regarding the prior and precise layout of the land, for when such contract is awarded to the joint venture were not available for municipal ownership of all parcels necessary for the execution of works to be carried out if the park next to Orchard Road and the arena.
What is more, negligently, the land that the City offers in exchange for all the works, are included in the Special Plan (PE-5) "field", which actually also includes almost 3,000 m2 belonging to several owners , which therefore are not local, which inexplicably is not noticed in the contract.
On the other hand the land that the contractor provides for the new stadium, were not urban order for that purpose, so that the City was required to do the necessary steps prior to the construction of the new stadium, particularly the drafting of a Special Plan as indication of the Ministry of Public Works, which in turn puts a whole series of objections, the Council also inexplicably, or make, or remedied, and this more than two years, preventing any action there.
However, from the socialist ranks, from the beginning we have publicly opposed this process, especially by the way has been developed, meaning that the land of the current soccer field and play a strategic role in any case "should reserve within the municipal heritage poor soil. "
He also warned that it was "acting in haste" and that "the effects of wind up paying the caravaqueños" as this has been confirmed, as now actually creates a significant financial loss, difficult to circumvent, to a municipality already heavily indebted.
To not be a situation that could become increasingly burdensome to the City, as it has been, we have noted that he had "to be studied to terminate the contract soon."
For this reason we have formally requested an extraordinary plenary session to address the issue fundamentally, with the single point: to provoke debate on the management of the Governing Board.
This request has also joined the United Left.
For our part, we are considering filing a motion on this issue at the plenary session and the request of the responsibilities of all types, if this debate convinces us nothing.
