Motion Municipal Socialist Group on a number of BIC (Cultural Property) (24/05/2009)

Alfonso Sánchez Marín, as spokesperson and representing the Municipal Socialist Group in the city of Caravaca de la Cruz, presented the following motion for the opinion and approval if required by the Town Hall Plenary Caravaca:

This local group filed a motion to the full month of October 2007 that was rejected by the PP government team, with which we wanted to urge the Ministry of Culture for the definitive statement of the records of Cultural Property ( BIC) opened in the town, still unresolved, to avoid expiration thereof.

This was because we were calling the recent Law 4 / 2007 of March 16, Cultural Heritage of the Region of Murcia (BORM 12-4-2007), as this introduces some new features with respect to the Law 16/1985 of 25 June on Spanish Historical Heritage which had been implementing so far.

Specifically, in regard to proceedings initiated for the declaration of BIC, the new law sets a limit of two years for final decision in the case of monuments.

Once this period has been published expressing its resolution will result in revocation of the same, as provided in Article 18 paragraph 1 and 3. In addition, the third transitional provision provides that for goods of cultural interest opened before on which no decision is final, the computing time limits referred to article 18 above shall be made after the entry into force of this Law on Cultural Heritage in the Region of Murcia.

Since the Act came into force on May 2, 2007, the deadline for the declaration of the BIC opened before, ended on May 2, 2009.

Taking into account the ratio of BIC catalog Heritage Service of the Ministry of Culture, corresponding to Caravaca de la Cruz, we note the following records of BIC initiated that are affected by the limitation period that we have noted, had not fallen final decision within the same:

City Hall, have exp.

Initiated since 1982.

The renovation of the building completed in 91, left a modernist interior, where only respected the main staircase and the Plenary Hall.

Convent and Church of the Society of Jesus, have exp.

Initiated since 1986.

The name is not appropriate because the Jesuits are not founded convents, if not college.

It has only restored the Church.

Tercia or Palace of the Knights of Santiago, has exp.

Initiated since 1982.

Building badly damaged.

Only the facade, and probably the first bay, is all that is in relatively good condition.

Church - Monastery of Our Lady of Mount Caramel, has exp.

Initiated since 1982.

Well preserved thanks to the restoration work undertaken.

Copper Mill beat (Heron) of Chopea has exp.

initiated by resolution of 02.06.2002.

Partially restored to prevent its collapse.

The expiration of the proceedings initiated will, from that time, non-provisional application of the protection regime provided for goods of cultural interest referred to in Article 13 4.

Of the monuments of Caravaca indicated above, only two have been declared permanently - "in extremis" - by decree of the Governing Council of the CARM, according BORM of May 2, 2009.

This is the Convent and Church of the Society of Jesus and the Church - Monastery of Our Lady of Carmen. The rest are no longer protection as Assets of Cultural Interest enjoyed so far, unless such records re-initiate.

The same has happened to a very large number of unresolved BIC records throughout the Region, which we consider should have been avoided.

Besides the above there are some unique buildings located within the Historic Caravaca those who have not been instituted BIC file:

The Church and Convent of the Clark is one of the real property that, despite deserving it, has not been initiated so far to record the statement of BIC, with the category of monument.

The conservation status of the convent is not adequate.

Have managed only covers more damaged.

We understand as a priority its proposal to initiate exp.

BIC.

Uribe's palace, which

now houses the Museum of the party restored to that effect. thought it might be of interest for both its origin initiation, for the current relevance of the building.

As for the Joint History Caravaca de la Cruz, is pending to address the necessary revision of the Special Plan and Interior Renovation of the Old Town Protection (PERI), which suffers from many shortcomings.

Likewise, in the Strait of Caves of the Incarnation, declared Historic Site in 2004, requires the drafting by the council of a Special Protection Plan of the area affected by the declaration.

We therefore propose as a priority for better protection of historical heritage of our town, the Plenary Council adopt the following:

AGREEMENT

Urging the Ministry of Culture to initiate new proceedings for the declaration of a Cultural monuments all Caravaca whose records have expired.

Urging, also, to the Ministry of Culture for the file being opened for the declaration of Cultural Property in the category of monument to the Church and Convent of the Clares, and the palace of Uribe.

That by the City of Caravaca is expedite procedures for the recruitment of the revision of the Old Town PERI.
